Distracted Drivers Cause Serious Accidents | New Hampshire Attorney

Though distracted driving is often used as a joke it is no laughing matter. 

A recent accident killed a motorcyclist as she waited for a red light to turn green.  Anita Zaffke was wearing a helmet at the time of the crash but still sustained life ending injuries when a car hit her from behind.  According to Lake County Sheriff Mark Curran the driver was, "painting her nails while she was driving her vehicle.  She conceded to us that she was not paying attention."  The driver was only given a ticket for failure to reduce speed.

This tragedy begs the question: Should distracted driving be a criminal offense? 

Currently the only distracted driver laws pertain to cell phone use, including text messaging.  However, any other distraction, from reading to eating in the car is just as dangerous.

The National Safety Council reports that distracted drivers cause more than a third of all automobile accidents.  John Ulczycki of the National Safety Council make the point that, "Drunk driving is now illegal.  Distracted driving needs to be illegal as well."

However critics believe that regulating distracted drivers can lead to unnecessary tickets and regulations.  They wonder where to draw the line.

"Truth be told, anything we're doing other than giving our full attention to the road is a potentially a distraction, but that doesn't make it a criminal case," states Darren Kavinoky, a California criminal defense attorney.
