Hospital | Doctor Negligence Case Goes to Court

Another case of hospital negligence is going to court. This case deals with the death of a woman after being treated in an emergency room in West Virginia.
In the lawsuit the Smith's lawyer alleges that Pamela Campbell Smith died after receiving substandard care at Montgomery General in Charleston, W. Va.
The medical malpractice lawsuit alleges that Smith was taken to the hospital complaining of a headache, vomiting and hypertension. She was administered drugs for pain and nausea and released an hour later.
Four hours after her release one of Smith's daughters called the hospital as her mother was "acting abnormally" and was unresponsive. An emergency room nurse gave advice and said that Smith had been given drugs and that she should be allowed to sleep off their effects. Hours later Smith died in her home. According to the Smith family the cause of death was high blood pressure or hypertension, the primary reason Smith was taken to the hospital.
The suit also alleges that a doctor from the emergency room wrote an anonymous letter to the family after the death. This letter, to be entered as evidence, gave a phone number and told the family to call it if they wanted to know why Smith died.
The family did call the number and reached Dr. M. Anwar Abdeen. The doctor stated that Smith died from a "nursing medication error". However, suspicion grew over the physician when it was discovered that he had been fired from theVeterans Medical Center.
The director of the center sent a letter to the licensure board in the four states where Abdeen was licensed. The letter stated that his performance "raise[d] reasonable concern for the safety of patients, as evidenced by the occurrence of multiple diagnostic and treatment errors."
In addition Abdeen had been removed from his position as emergency room medical director two weeks before Smith was treated, yet he continued to see patients in the emergency room.
The medical malpractice lawsuit seek damages against both the hospital and Dr. Abdeen. Medical malpractice lawsuits around the country and across New Hampshire are also on the rise.
