Georage Gamas worked for Anheuser-Busch in Merrimack for over 20 years. When he became ill and attempted to file for disability benefits he was denied. The New Hampshire Compensation Board*re-do when library added* ruled that Gamas waited too long to file his notice. The board ruled that he should have known that his asbestosis was related to his work and therefore should have filed earlier than he did.
However the New Hampshire Supreme Court is going to allow Gamas to reapply for workers compensation benefits. The court reversed the CABs ruling and has sent the case back for further review.
According to records, Anheuser-Busch had been made aware of Gamas' on the job injury by May 23, 2004, the date the CAB set as a reporting deadline for Gamas. However, a doctor's report had been filed by that date and a few months later a civil suit had been filed by Gamas and his attorney. His deposition indicated that he was suffering from an asbestos related lung condition. The condition was caused by his exposure to asbestos during his employment.
During the civil suit an environmental safety manager admitted that he was "put on notice" of Gamas condition.
