A: Mediation is a valuable process that we recommend in many of our cases.  It is an informal process, which in no way binds you to an agreement.  Rather, it is a negotiation process where the parties control the substance of the discussions and the scope of any agreement reached. It is beneficial in disputes where the parties have been unable to reach an agreement but have expressed a desire to settle without going to court. It is also beneficial, even if you are willing to go to court.  During the mediation, all communications and information shared is confidential, and will not be admissible should you have to litigate this dispute.  Furthermore, mediation can avoid the costs and delays of litigation.
