Our client Bill N. a disabled veteran suffered from a chronic debilitating skin disease known as hydradenitis suppurativa. He was treated at the Veteran’s Administration Hospital in White River Junction Vermont. Despite the inability of the doctor’s at the hospital to treat the condition they did not refer him to a specialist. Instead he languished in the hospital and then a nursing home. His local attorney contacted  Van Dorn & Curtiss for help and our research showed that had he been referred to a specialist he could probably have been treated successfully and  gone home to lead a relatively normal life. We also learned from experts we consulted that under the circumstances when treating physicians do not have the expertise to competently treat a condition they have a duty to refer the case to a specialist. This the VA Hospital failed to do. We brought suit on Bill N.’s behalf. The Vermont US Attorney’s Office defended the VA and adamantly denied any wrongdoing. After years of litigation and before the case went to trial the VA paid a one million dollar settlement.
